Who can you be with during curfew? Summer curfew - what is it? Forbidden times in other countries

In cases where the authorities of a state cannot fully control security on the streets of large cities, as well as in the event of a mass potential danger, for example, in the event of a terrorist threat or on the eve of a natural disaster, it imposes certain restrictions on citizens. Typically, these restrictions are referred to as curfews and encourage community assistance and make it easier for law enforcement to keep order on the streets.

Features of the introduction and legal regulation of the curfew

The curfew imposed in the city has a legal basis and is regulated by the Constitution of the country and the Family Code, and in addition, Federal Law No. 124 applies to persons under the age of 18. In accordance with these laws, minors or all categories of citizens in the case of , if the territory of their residence is a potential danger, must comply with the following requirements:

  • Not to appear on the streets or in places intended for leisure or entertainment, after a certain time set in the requirements of the authorities.
  • Persons under the age of 18 do not have the right to be in places where alcoholic products are sold without being accompanied by elders.
  • All children under the age of 7 have the right to be in crowded places only if accompanied by adults authorized to take care of them.
  • Local governments in each region of the country have the privilege to independently determine the curfew conditions in the territory. This situation is associated with the aggravation of specific problems in the area, as well as with the tension in the sphere of the criminogenic situation, which in turn directly depends on the stability of the economic situation.
  • Violation of the rules entails administrative liability in the form of a fine or other disciplinary action, depending on the severity of the consequences of ignoring the law.
  • The implementation of the requirements of the law is monitored by law enforcement agencies patrolling the streets of the city.

Important! These measures are taken in the state or its individual subjects in order to reduce the crime situation in the area and protect the population from encroachments on the life, health and property of citizens, as well as to ensure more productive isolation of asocial individuals. As a rule, the curfew time is from 22:00 to 23:00.

Teenagers on the street

Curfew for minors

All teenagers are required to obey the current law that establishes a curfew, and while for other citizens it is valid only for a certain period of time, for minors this ban has been introduced on a permanent basis. So, according to the requirements of the authorities, children and adolescents do not have the right to the following actions:

  • Walking, as well as staying on the street, stadiums, restaurants, shops, stops, train stations or other places intended for the general public after 23:00 without being accompanied by authorized persons or older relatives if their age is from 16 to 18 years.
  • Carry out the same actions, but after 22:00, when the teenager is not yet 16 years old.
  • For all ages of children and teenagers, the curfew ends at 06:00, when the activity begins in the city, and people rush to do different things, filling the streets.
  • The summer curfew in some federal subjects, especially in the North-Western part of Russia, where there are white nights, can be shifted until midnight.
  • In autumn and winter, as a rule, all prohibitions on the stay of minors outside the home begin at 22:00.
  • The winter curfew period, as a rule, starts from 01.11 to 31.03, summer - from 01.04 to 30.10.
  • In some regions of the country, for example, in the Leningrad region, during the festivities in new year's eve the curfew is canceled altogether, as the authorities record a significant decrease in crime in this period. In addition, this relief is present in local legislative documents in various regions, since national, ethnic, religious and other holidays can be observed there.

Detention for violating the ban

Important! The ban was introduced in 2010, and since then more than 5,000 violations of this regime have been identified, as a result of which thousands of parents have been subjected to significant fines, and the crime rate in the country has almost halved in the last five years.

Who is eligible to act as escorts during the ban

Not every outsider has the right to play the role of an escort, since he must have certain public powers. Thus, the following persons have the right to accompany minors during the time limited for staying outside the home:

  • The child's parents or one of them.
  • Official guardians, endowed with legal authority to exercise parental rights and responsibilities.
  • Trustees, adoptive parents, as well as official authorized employees of institutions intended for long-term or short-term stay of children and adolescents, namely schools, universities, colleges, children's camps, etc.
  • Representatives of guardianship and guardianship authorities.
  • Bodies that carry out outreach activities aimed at maintaining the health of young people.
  • Social services, various rehabilitation institutions (including sanatoriums), labor and recreation camps at schools or other institutions, sports schools that hold field competitions, however, in such cases, the organizers of the event use chartered transport.
  • Other persons and representatives of organizations endowed with permanent or temporary powers to carry out educational and preventive work with the younger generation.

Important! When checking the accompanying person during the curfew by law enforcement officers, he is obliged to present the documents or license certificates he has that give him the right to stay next to the child.

Danger at night

What is the liability for violating the prohibition?

Any violation of the current legislation entails some kind of punishment, and ignoring the curfew is no exception. So, the teenager himself or his responsible guardian may be subject to the following types of administrative action if he is outside at the wrong time:

  • If a minor is over 16 years old, he will personally be fined in the amount of 100 to 500 rubles*, which is exactly what is required to draw up a resolution and pay for the work of the police. However, unfortunately, such punishment, alas, is often not enough.
  • In those situations when a teenager, who found himself on the street without parents at a forbidden time, caught the eye of law enforcement officers, he will be taken to the station, where his guardians will be called for a preventive conversation and the same fine will be issued.
  • If a legal entity or its responsible representatives, including employees of various state structures, are behind the violation of this prohibition, the amount of punishment may already be from 10.0 to 50.0 thousand rubles. depending on the time of day, the region where the offense was committed and the activities that teenagers were doing during the prohibited time.
  • If during the period of violation of the prohibition any non-standard situation occurs leading to death, harm to health, loss or damage to the property of a minor, parents may bear responsibility for it, as persons who are obliged to fully ensure that the teenager complies with the laws of the country. Thus, as a result of such situations, guardians can be fined large sums, placed under arrest, deprived of parental rights, and in the most difficult scenarios, criminal liability comes.

Curfew Schedule

Important! Punishments for violating the curfew are stipulated in Article 5.35 of the Code of Administrative Offenses of the Russian Federation, which tells about the onset of administrative responsibility for failure to fulfill the assigned social duties on parents or guardians for the upbringing of a minor citizen. In addition, in high school for children in social studies lessons, they necessarily inspire the need to comply with the requirements of this section of the code.

Conditions for lifting the curfew

The introduction of a curfew is a fairly common practice in many countries, especially for minors. So, during its operation in the state, not only the level of crime against adolescents, or, on the contrary, on their part, is falling, but also control over such pressing issues as teenage alcoholism or drug addiction is also being strengthened. However, in a number of countries, from time to time, these laws become unpopular and are criticized, and this happens for the following reasons:

  • First of all, if the curfew was a temporary phenomenon, for example, during riots, armed conflict or before a natural disaster, then when the external danger leaves, it will be canceled, since the risk to life and health of people ends.
  • When the authorities of the country set themselves specific goals in reducing the crime situation in the city and achieve these goals after a few years.
  • In cases where trade union organizations, human rights societies or democratic parties that have political weight in the state initiate unrest and mass criticism, claiming that the curfew violates the rights and freedoms of citizens.

Lifting the curfew

Important! Regardless of criticism, parents and guardians of adolescents, understanding the level of their responsibility in the absence of external prohibitions, are not at all happy with such indulgences and do not support the absence of a curfew.

In conclusion, it should be noted that the establishment of a curfew is by no means intended to violate the rights and freedoms of a democratic society, and all efforts are aimed at ensuring the safety of the population. Yes, on the roads. Russian Federation traffic rules have been established, safety requirements are in place at production facilities, swimming and movement of small vessels are prohibited in coastal cities during a storm, and all citizens understand the desire to take care of them on the part of the authorities. The introduction of a curfew should also be taken into account, given that most offenses, crimes or antisocial acts are committed at night, with a limited number of people outside their homes.

Teen work

However, these situations also have a downside, since many conscious teenagers aged 16 and older can already study at universities for 2 years and come home late, and some of them even try to earn extra money to secure a decent young life or help their parents. . Often, such employment happens in the evening, and, sometimes, at night. Thus, returning home after work at 00:00, a teenager falls under the ban, despite the nobility of his actions, and in this case there is a certain conflict between the requirements of the law and the problems of the emancipation of children, as well as their adaptation in society.

*Amounts of fines are current for 2018.

Russian teenagers may soon be unable to go out at night. Policemen rightly believe that the introduction of a curfew can help reduce juvenile delinquency, but the development of the relevant bill has been going on for a very long time. The government fears that the introduction of a ban on teenagers being in public places and on the street at night can cause a wave of misunderstanding and hostility on their part. After all, this is, in fact, a serious violation of the rights and freedoms of schoolchildren.

Proper leisure

In the capital, a curfew for teenagers has already been introduced by the Moscow authorities on January 1 this year. Now, according to the Code of the City of Moscow on Administrative Offenses of November 21, 2007, persons under 16 years of age are prohibited from appearing at discos and even in Internet cafes after 23:00. True, there are certain difficulties in implementing this law. Firstly, the system of fines for violations does not work - the police can impose them on parents only by catching their child at night several times in a row. Most often, verbal warnings have to be issued. In addition, in Moscow there is no patrol service that would deal specifically with teenagers walking without parents at night through the streets. To detain a teenager, you need to go to one of entertainment venues- just on the street to stop him while no one has the right.

OUR REFERENCE. Code of Administrative Offenses of the city of Moscow, article 3.12. Connivance of finding minors in public places at night without being accompanied by their legal representatives.

Connivance of the presence of a minor under the age of sixteen in the premises of a legal entity or an official engaged in activities in the field of entertainment (leisure) - in gambling establishments, restaurants, cafes, bars, clubs, cinemas, other premises used in the field of entertainment (leisure) ), - at night (from 11 p.m. to 7 a.m.) without being accompanied by their legal representatives (parents, adoptive parents, guardians, trustees) - shall entail the imposition of an administrative fine on officials in the amount of two thousand five hundred to five thousand rubles; for legal entities - from ten thousand to thirty thousand roubles.

According to the new law of the city of Moscow, after 23:00, the doors of cafes, clubs, cinemas and other establishments will be closed to minors unaccompanied by their parents. This topic turned out to be especially acute for Moscow parliamentarians, because a few years ago they already adopted a similar city law. However, as it turned out, it practically did not work. According to statistics, for the whole year only ten people were brought to justice under this law.

Now the Moscow City Duma has demanded to ban teenagers from visiting leisure facilities at night and to lay responsibility for the violation not only on their parents, but also on the owners of entertainment establishments themselves.

The legislators suggested, and the policemen confirmed, that it was high school students and secondary school students who special institutions are the most frequent visitors to places of entertainment and leisure. Meanwhile, there is a serious danger of instilling in them the skills of an idle lifestyle and involving them in illegal activities.

At the same time, employees of the juvenile affairs inspectorates note that the problem cannot be solved only by prohibitive measures. Teenagers kicked out of nightclubs are unlikely to go home - they will look for entertainment in other places available to them. It is necessary to solve the problem in a comprehensive manner: in particular, we should talk about the need to organize teenage leisure. Otherwise, all the teenagers will end up on the street and just start drinking there.

Teenage alcoholism

Crimes among young people often occur now because minors are addicted to beer, and after drinking it, they lose all control over themselves. Legislators believe that it would be better if young people stop drinking this drink altogether. The specialists who carried out the chemical analysis of the beer came to the conclusion that its strength significantly exceeds the allowable norms indicated on the label. Given the unformed body of a teenager, beer catastrophically harms the physiological and spiritual development of the individual.

OUR REFERENCE. 1 million 650 thousand children and adolescents under the age of 15 live in the capital, every year 165 thousand of them end up in traumatology departments of children's hospitals with injuries also received while intoxicated.

OUR REFERENCE. Every year, juveniles or with their participation commit approximately 300,000 crimes and about 700,000 administrative offenses throughout the country. The number of murders committed by them has increased by almost 20% today.

Representatives of the alcohol business in the event of the adoption of such a law, of course, will suffer certain losses. But the health of the younger generation is more important. And according to the latest data, almost every fifth Moscow teenager suffers from mental disorders. And this, among other things, is a consequence of an early addiction to alcohol.

Even the Union of Russian Brewers has joined the fight for a healthy generation. They themselves proposed to the Government the introduction of penalties for parents whose minor children consume beer. Fines will be issued in the amount of 3 to 5 times the minimum wage. In addition, for attracting a minor to drink beer, a fine of 1 to 3 minimum wages is expected for a stranger, and for the same actions committed by parents, a fine will be from 15 to 20 minimum wages.

Violation of restrictions on the retail sale of beer entails the imposition of an administrative fine on officials in the amount of 20 to 30 minimum wages. For legal entities, the fine will be from 200 to 300 minimum wages. The law also provides for the introduction of administrative liability for the consumption of low-alcohol products with an ethyl alcohol content of less than 12% in children's, educational, medical organizations, on all types of public transport, in cultural organizations, sports and recreational and sports facilities in the form of a fine in the amount of 1 up to 3 minimum wages.

The legal basis for this draft law is the federal law "On Restrictions on the Retail Sale and Consumption of Beer and Beer-Based Drinks", which came into force on April 15, 2005. The law provides, in particular, a ban on the retail sale of beer to minors, as well as on the consumption of beer by minors in public places.

street parties

So far, policemen can take teenagers from the streets only for violating the city law on silence. The amendments to it were also adopted in the first reading by the Moscow City Duma. First of all, innovations are associated with a significant increase in fines for such offenses.

OUR REFERENCE. Code of Administrative Offenses of the city of Moscow, article 3.13. Violation of the peace and quiet of citizens Committing actions that violate the peace and quiet of citizens from 11 p.m. to 7 a.m. in the protected territories and in protected premises established by the legislation of the city of Moscow, with the exception of actions aimed at preventing offenses, eliminating the consequences of accidents, natural disasters, other emergencies situations, carrying out urgent work related to ensuring the personal and public safety of citizens in accordance with the legislation of the Russian Federation, actions performed when performing religious cults within the canonical requirements of the relevant confessions, as well as when holding cultural events authorized by state authorities or bodies local government in the city of Moscow,

It entails a warning or the imposition of an administrative fine on citizens in the amount of five hundred to one thousand roubles; on officials - from two thousand to four thousand roubles; for legal entities - from twenty thousand to forty thousand rubles.

Recall that the law on administrative responsibility for disturbing peace and quiet at night in the capital was adopted in 2002. From 22 pm to 6 am in the capital it is forbidden to shout, whistle, sing loudly, use TVs, radios and tape recorders at high volume. For six years, the ratio of average earnings and the minimum wage has changed dramatically. This is the reason for the toughening of administrative penalties.

Separately, the amendments prescribe liability for minors. In this case, a warning or the imposition of an administrative fine in the amount of 1 to 10 minimum wages is imposed on the parents or legal representatives of adolescents.

However, according to the new law, a violator of peace and quiet can get off with a warning. This penalty may be applied if the violation is eliminated on demand. But if in one year a citizen violates the silence again, he will be liable in double the amount of the established fine.

Affairs Inspectorate

minors

To find out how juvenile inspectors work under the new Moscow laws, our correspondent went to the Perovo district. Another raid "Teenager", conducted by the local police department, was dedicated to the search for violators among the owners of nightclubs who want to benefit from schoolchildren.

Night discounts for children and teenagers - such a special offer was introduced by one of the computer clubs on the Enthusiasts Highway. In order for the equipment to bring round-the-clock income, the guys were invited here to play at night at reduced rates. The local administration did not care that, according to the law of the city of Moscow, all teenagers should be at home with their parents at eleven o'clock in the evening.

All such institutions for teenagers are required to work until 23:00. Such a schedule was indicated on the official signboard of the Connect computer club. However, the administration, in pursuit of revenue, worked until the last client. No one sent home the guys who stayed up late. On the contrary, all their buddies were invited to join in to play at discounted nightly rates. The club worked underground until the morning - the guys were let in here, after which they locked the door.

The policemen had to break into this place. It was impossible not to hear the loud thud of hands and feet on the metal structure, but the administration was not going to unlock it. The club's employees backpedaled only when the inspectors threatened to call the Ministry of Emergency Situations and open the doors with special means. Hearing such a statement, the club manager decided to unlock the door after all.

It turned out there was something to hide. Of the dozen people who decided to spend the night in this

club, three were minors. Schoolchildren Mishka and Sasha, whom we found behind the local computer tables turned out to be only twelve years old. Their older friend Sergei is fifteen. It was he who told his friends about the cheap underground club, so they came to play. Such teenagers, according to police officers, were here regularly, since it was twice cheaper to sit at the computer at night.

Surprisingly, the parents of teenagers at 12 o'clock at night did not try to look for them. Inspectors had to call insolvent dads and moms. It turned out that many parents knew that their child went to play. For some reason, the delay of the child after midnight did not bother them. Naturally, no one has heard of a new law prohibiting children from nighttime entertainment. The defenders of the interests of the younger generation had to call all the parents of these children to a closed club.

Fathers and mothers who were not particularly interested in where their children were at night now face a fine of up to five hundred rubles. And the owners of the institution, which was supposed to stop working on time, are waiting for more serious sanctions, up to the closure of the club.

As the administrator of the computer club "Connect" told us, in addition to the official schedule, they also had their own internal routine, according to which anyone could book in advance the night hours of visiting the club. However, in any case, such services had nothing to do with adolescents.

In addition, the police did not find any documents confirming the words of the administrator. None of the management came to the club at night. It turns out that the club worked without any permits at all.

Of the parents of teenagers, only one mother appeared.

Confused Irina Laricheva, the mother of a 12-year-old schoolboy, could not find what to answer. The inspectors are sure that the woman knew about the whereabouts of her son, but turned a blind eye to it.

According to Pavel Kolemasov, head of the department for juvenile affairs, such a disregard for the child's leisure will not lead to anything good. Children should be at home with their parents, be prepared for the learning process and have a good night's sleep before a new day at school.

Mishka's mother at least came for him, and the inspectors had to call all the other parents again and insistently invite them, but this time to the police station. After a preventive conversation, they will definitely be issued a fine of 5 minimum wages. Maybe at least such sanctions will make parents think about where their child disappears at night.

As for the club itself, the fines are much more serious for it. A report on illegal night work has so far been issued to the administrator, who himself has only recently turned 18 years old. Whether the leadership will stand up for him is unknown. It is possible that the senior mentors will decide to evade responsibility and claim that the young man continued to work at night of his own free will.

Now the computer club "Connect" was closed and sealed. He will be able to resume work only after paying a fine of many thousands and promising to continue to close at night.

Konstantin DODONOV

On the territory of Russia, in accordance with the curfew law, children under the age of seven cannot be alone on the street at any time of the day. Children aged 7 to 18 should not be unaccompanied by adults in public places: parks, squares, restaurants, cafes, etc. at night time. How long is the curfew? IN winter time its action extends from 22 to 6 hours, and in the summer - from 23 to 6 hours. In addition, regional authorities have the right to shift the curfew in accordance with climatic conditions. If a curfew violator is found, law enforcement officers must establish his identity, home address and information about his parents. If the place where the parents or guardians of the child can not be established, he is sent to a specialized institution. In relation to the parents of a violating child, an administrative protocol is drawn up and a fine is imposed for violating the curfew in the amount of 300-1000 rubles.

Everyone knows that the night is not the time for children's walks. Recently, this tacit rule has gained legal force, because starting from 2012 in Russia, and from 2013 in Ukraine, legislative acts on curfews for children and adolescents began to operate. Despite some differences, the main essence of the laws of both the Russian Federation and Ukraine is the same - children and adolescents are prohibited from being in public places after nighttime without adults: parents or legal representatives.

Curfew for minors in 2020

In both cases, leaving the house is allowed by the government only from 6.00 in the morning. In other situations, during the curfew, they have the right to be somewhere outside the walls of the house only in the presence of their parents, or you are in the presence of persons who have the right to take on such responsibility.

The terms of the time limit apply only to minor children, and according to our legislation, they are young people under the age of 18. There is even language such as curfew for students. After all, studying in a higher educational institution does not mean the presence of the age of majority.
Commandant's tea in each season has a different time frame and differs by age category. There are differences in time limits for visiting public places in different regions of our country.

Curfew at 16

Curfew procedures are regulated by the family code and the Constitution of the Russian Federation. Since 2009, the Federal Law “On Basic Guarantees of the Rights of the Child in the Russian Federation” has been amended to define the rules for minors to be in public places at night. Children under 7 years of age should not be outside the home without an adult at any time of the day.

What is the curfew for minors? Persons under the age of 18 should return to their parents before 22:00. Each subject of the Russian Federation independently establishes forbidden places to visit in accordance with local regulations and criminal situation. In addition, local governments can reduce restrictions at night, focusing on the climatic and seasonal conditions of the area and the age of persons to whom the law applies.

14 years old) Hello, from what time and until what time is the curfew in St. Petersburg in 2020

- measures to prevent the presence of children (persons under the age of 18) at night in public places, including on the streets, stadiums, parks, squares, vehicles for general use, at facilities (on territories, on premises) of legal entities or citizens carrying out entrepreneurial activity without forming a legal entity, which are intended to provide access to the Internet, as well as to provide services in the field of trade and public catering (organizations or points), for entertainment, leisure, where, in the manner prescribed by law, retail alcoholic products, beer and drinks made on its basis, and in other public places WITHOUT being accompanied by parents (persons replacing them) or persons carrying out activities involving children.

- reduce, taking into account seasonal, climatic and other conditions, night time, during which it is not allowed for children to be unaccompanied by their parents (persons replacing them), as well as persons carrying out activities involving children, in designated public places;

Curfew for underage teenagers

It states that children under the age of 18 should not be in public places, on the streets, stadiums, parks, squares, public transport, on the territories and premises of legal entities or citizens who carry out entrepreneurial activities, as well as in places for entertainment and leisure where alcoholic products are sold, unaccompanied by parents or citizens carrying out various activities involving children.

Other children attend sports sections and other additional activities that can last until late. The ban on movement at night also includes the inability to travel in public transport, which also makes it difficult for minors to return to their homes.

From April 1, the "curfew" in the Irkutsk region begins later

In accordance with the legislative document, minors are prohibited from being in public places from 11 p.m. to 6 a.m. unless accompanied by their parents or legal representatives. Moreover, the list of places where it is forbidden for children to be unaccompanied by adults is quite wide. Streets, stadiums, parks, squares, public transport, Internet clubs, construction sites, roofs, attics, basements and other public places at the specified time for minors under the ban.

The police recall that from April 1, in accordance with the law of the Irkutsk region "On certain measures to protect children from factors that negatively affect their physical, intellectual, mental, spiritual and moral development in the Irkutsk region", the so-called "curfew" will be reduced by hour.

Curfew

With the support of one of the parties, a poll was conducted, the main topic of which was this law. Most people, including young people, agreed that a curfew was indeed necessary. This can significantly reduce the number of accidents that happen to children on the streets at night.

Previously, the police fined the owners of bars where children entertain at night, and negligent parents, despite inconsistencies in the law. But now the courts are increasingly recognizing the protocols issued by the employees of the internal affairs bodies as invalid. And an internal order swept through the departments of the Ministry of Internal Affairs - not to mess with the regional laws on the "curfew".

05 Aug 2018 1933

Recently, the state has been making sure that the younger generation is actively developing, including physically, culturally and morally.
If on the first point, with regard to physical development, everything is clear, this requires the construction of playgrounds, children's cultural centers, sports sections and much more that will help the child develop, then I will greatly forgive everything with cultural and spiritual development.
From the perspective of the state, of course.

In order for teenagers to have the opportunity to develop culturally, spiritually and morally, the government decided to restrict the latter from moving at night along the street, public places (public transport, public places, parks, squares, other entertainment places).

For this purpose, it was adopted The federal law No. 4900 of May 11, 2009, which directly indicates that minors would have the opportunity to develop to the extent necessary for their normal and full development in society.

Age restrictions

Many are interested in the question of how many years the curfew is at 14, 16 and 17 years old
The legislator established that persons under the age of 18 cannot be in public places, without being accompanied by their parents or legal representatives.

However, it is provided that the local authorities of a particular region, referring to their internal traditions and cultural foundations, have the right to reduce this age, but not more than 2 years.

This was done because Russia is a multinational country, with big amount peoples and nationalities. Where the cultural peculiarity of teenagers differs sharply from the peculiarity of teenagers who are considered to be Russians by nationality.

For example, young men and women in Russia's North Caucasus are physically maturing faster than their peers in central Russia.

Temporary restrictions

The legislator established that the period of time from 22:00 to 06:00 is considered night time.
Thus, a curfew is established for adolescents under the age of 18 and in the period from 22 to 06 in the morning.

At the same time, the Legislator established that for a particular region during the summer period, the curfew can be reduced.
In most regions of Russia in the summer, it is valid not from 22, but from 23 to 6 in the morning.

It should be noted that in certain regions of Russia, restrictions on being on the street in the evening are valid for the age group.

For example, in Crimea, these indicators are as follows:

Children under 7 years old must be with their parents at any time of the day.

From 7 to 14 is on the street until 21 hours.

From 14 to 18 years old until 22 hours.

In general, the state took such steps due to the large percentage of children getting injuries in the evening and at night, bodily injuries during fights and clashes. Responsibility for beating article 115 of the Criminal Code of the Russian Federation can be read

Responsibility

If a teenager under the age of 18 is found by the police in public places and unaccompanied by parents or legal representatives, the latter will be subject to an administrative fine under Art. 5.35 of the Code of Administrative Offenses of the Russian Federation for failure by parents to fulfill their obligations to raise minors.

The amount of the fine is from 100 to 500 rubles. However, if such an administrative offense is detected for the first time, police officers may confine themselves to a warning.

Curfew - a ban on staying on the street, public places without permission at certain times of the day (usually at night).

This rule, approved by law, is introduced in dangerous periods, in wartime in order to avoid many crimes or as a guarantee of the safety of the younger generation, as well as to establish and maintain order, reduce the number of victims in a state of emergency.

In peacetime, a curfew is a period of time during which children are not allowed to be alone in public places.

Most crimes are committed at night. In different regions of the Russian Federation age restrictions and time frames regarding curfews differ.

Consider the rules and features of the curfew for minors in 2020.

Children and teenagers are subject to curfews to reduce crime and keep children safe. Most crimes are committed at night.

It is more convenient for a robber to attack civilians and seize their property at night, so that it would be more difficult for the victims to identify the attacker. The observance of the curfew is monitored by special units of the troops or the police.

The stay of minors outside the home at night is prohibited by law. Children and adolescents from 7 years of age to the age of majority should not be in public places after eleven o'clock in the evening alone.

Children under 16 must be at home with adults after 22:00. The summer curfew for minors is extended by 1 hour.

Who can you walk with at night? Only with parents or other adult trustees. Also, teenagers should not be in public places until 6 am. Local authorities have the right to reduce this time.

The curfew is in effect on a permanent basis during:

  • martial law;
  • riots;
  • natural Disasters;
  • for other reasons.

The curfew in the Russian Federation restricts visits by children under 16 to the following places:

  • streets;
  • stadiums;
  • parks;
  • stations;
  • public transport stops;
  • outlets and territories;
  • cafes, restaurants, especially those where you can order alcohol;
  • educational and cultural institutions;
  • entertainment points.

Who can accompany minors is determined by law:

The rules for the presence of minors in public places are enshrined in the Family Code and the Constitution of the Russian Federation.

There is also a law on the presence of minors on the street after 22.00, N 124-FZ of 07/24/1998, which is called “On the Basic Guarantees of the Rights of the Child in the Russian Federation”.

And in April 2009, Law N 71 “On Amending the Federal Law “On Basic Guarantees of the Rights of the Child” was introduced.

It states that children under the age of 18 should not be in public places, on streets, stadiums, parks, squares, public transport, on the territories and premises of legal entities or citizens who carry out business activities, as well as in places for entertainment and leisure, where alcoholic products are sold, unaccompanied by parents or citizens carrying out various activities involving children.

With children under the age of 7, there must always be adults in public places. Each subject has the right to independently establish prohibited places for a child to visit (taking into account local regulations and the general criminal level).

The authorities have the right to reduce restrictions at night, taking into account the climate and seasonal conditions of the area, for this reason, in each region, the features of the curfew are slightly different. In fact, the permitted place at a later time for minors is their own home.

What happens if a child walks at the wrong time? Responsibility for violation of the law is provided for in Article 5.35 of the Code of Administrative Offenses(failure to fulfill obligations for the maintenance and upbringing of a minor child).

Usually parents have to pay a fine. If the child is seen without adults, the police will first establish his identity, the phone number of the parents, information about them, their occupation.

If the adults responsible for the child are not found, the minor will be sent to a specialized institution.

Many parents are concerned about whether a minor can be interrogated. The law does not prohibit this, but provides for a special procedure for interrogation.

The official is obliged to conduct the interrogation with the utmost care. The minor is explained that it is necessary to tell the circumstances of the case truthfully and in full. A minor witness is not liable for giving false testimony.

Responsibility for violation of curfew rules is established by the subjects of the Russian Federation.

Measures of influence apply to parents or people who replace them, as well as to citizens and legal entities that organize events with the participation of minors and have committed these violations.

The fine for finding minors at night varies from 100 to 500 rubles..

If violations are repeated, the amount increases. Establishments that cause minors to be out of their homes at night pay a fine of 10,000-50,000 rubles.

In Moscow, the Altai Territory, the Kemerovo Region and some other regions of the Russian Federation, minors cannot be in public places without being accompanied by their parents and guardians or persons replacing them:

  • 22.00-06.00 (from November 1 to March 31);
  • 23.00-06.00 (from April 1 to October 31).

In St. Petersburg, Law No. 48-14 of February 19, 2014 entered into force, according to which minors cannot be in public places at night without adults:

  • 22.00-06.00 - September 1 to May 31;
  • 23.00-06.00 - June 1 to August 31.

Restrictions do not apply on the night of December 31 to January 1, as well as during the holidays, which were organized by state authorities in St. Petersburg and local governments of the city.

Parents who break the law pay a fine of 3,000 rubles, legal entities pay 15,000 rubles, children aged 16-18 pay 3,000 rubles. If the violation repeats within a year, you will have to pay 5,000-20,000 rubles.

The law does not apply to adolescents under 18 years of age who have been recognized by the court as emancipated, or who have entered into marriage.

In Bashkiria, the curfew was increased in 2014. Children under 17 have the right to be in public places without parents from 06.00 to 24.00.

in Perm and Perm region other restrictions apply. Minors cannot be outside without their parents:

  • 23.00-06.00, period May 1 - September 30;
  • 22.00-06.00, period October 1-April 30.

In Bryansk, minors can be in public places without a mother or father from 23.00 to 06.00 all summer. From September 1, they are required to return home an hour earlier, as the curfew is being reduced.

Not all citizens enthusiastically adopted the law on “non-childish” time. But the normative act was created to protect minors from negative factors that affect the mental, moral, spiritual education of the younger generation.

However, many parents claim that the legislation does not take into account various nuances . Some high school students and underage students have to earn extra money after class and return home after midnight.

Other children attend sports sections and other additional activities that can last until late. The ban on movement at night also includes the inability to travel in public transport, which also makes it difficult for minors to return to their homes.

The curfew was introduced to ensure the safety of the younger generation, since most of the offenses are committed at night.

And the lack of parental control over the behavior and leisure of children at night is one of the reasons why teenagers commit illegal acts.

The adoption of this law is designed to ensure the protection of children and adolescents from various negative factors that affect their development, prevents the commission of crimes and unlawful acts in which minors are the object of criminal attacks.

It is expected that thanks to normative act on the prohibition of minors in public places without parents, the crime rate will decrease, but the law needs to be improved.
